This Privacy Notice for Varun Kumar (sole proprietor) (doing business as Yorcle) ("we," "us," or "our") describes how and why we might access, collect, store, use, and/or share ("process") your personal information when you use our services ("Services"), including when you:

  • Use Yorcle, an AI-powered platform for restaurants. Our Service integrates with restaurants' messaging channels (such as WhatsApp and SMS) and point-of-sale systems (Square) to handle complex customer orders, reservations, answer questions, and process transactions on the restaurant's behalf. The Service supports order flows for dine-in (including QR code ordering) and pickup, with delivery in development.
  • Engage with us in other related ways, including any marketing or events

Our Role as a Data Processor

When Yorcle processes personal information about restaurants' end customers (such as order history, phone numbers, and conversation content), we act as a Data Processor on behalf of the restaurant, which acts as the Data Controller. The restaurant is responsible for obtaining appropriate consent from its customers for this data processing and for ensuring compliance with applicable consumer-facing laws. Yorcle processes this data solely to provide the Service as instructed by the restaurant.

When restaurants sign up for our Service, they confirm that they have the right to collect and process their customers' data through our platform and will obtain required consents from their customers for automated messaging and data processing per applicable law.

1. What Information Do We Collect?

Personal Information You Disclose to Us

In short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

The personal information we collect may include:

  • Passwords
  • Contact preferences
  • Contact or authentication data
  • Billing addresses

Sensitive Information

Yorcle does not collect sensitive personal information. When users share health-related information (such as allergies or medical dietary conditions) in the course of ordering, our system stores only the dietary preference that results from it (for example, "gluten-free" or "avoid peanuts") rather than the underlying medical condition. This preference is used solely to improve future ordering experiences. Similarly, dietary categories such as halal, kosher, or vegan are stored as dietary preferences, not as indicators of religious or philosophical belief.

Payment Data

We may collect data necessary to process your payment if you make purchases, such as your payment instrument number and the security code associated with it. All payment data is handled and stored by Square and Stripe. You can find their privacy notices here:

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Information Automatically Collected

In short: Some information — such as your IP address and/or browser and device characteristics — is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, country, approximate location, and information about how and when you use our Services.

The information we collect includes:

  • Log and Usage Data. Service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services.
  • Device Data. Information about your computer, phone, tablet, or other device, such as device and application identification numbers, browser type, hardware model, and operating system.
  • Location Data. We collect approximate location data based on your IP address. We do not collect precise GPS coordinates from your device.

Information Collected From Other Sources

In short: We collect limited business information from public sources to support B2B outreach to restaurants.

We may collect publicly available business information about restaurants from sources such as business directories and restaurants' own publicly accessible websites for the purpose of B2B outreach regarding our Services. This information is limited to business contact details (business name, business address, business phone number, business email, and publicly listed social media handles) and is used solely to inform restaurant decision-makers about our Service.

We also receive information about end customers when they message a restaurant using our Service. This information is provided by the messaging platform (WhatsApp via Meta, or SMS via Twilio) and includes the customer's phone number, profile name, and message content.

We do not engage in targeted advertising, affiliate marketing programs, retargeting, or purchase data from data brokers.

If you are a UK or EU resident whose business contact information we obtained from public sources, you have the right to know we hold your information, request access to it, and request deletion. Please contact us at privacy@yorcle.com.


2. How Do We Process Your Information?

In short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law.

We process your personal information for a variety of reasons, including:

  • To facilitate account creation and authentication. We may process your information so you can create and log in to your account.
  • To deliver and facilitate delivery of services. We process your information to provide you with the requested service, including processing orders, handling reservations, managing dine-in flows, and integrating with the restaurant's Square POS.
  • To respond to user inquiries and offer support. We process your information to respond to your inquiries and resolve any issues.
  • To send administrative information. We may process your information to send you details about our products and services, changes to our terms and policies, and other similar information.
  • To fulfill and manage your orders. We process your information to fulfill and manage orders, payments, returns, and exchanges made through the Services.
  • To request feedback. We may process your information when necessary to request feedback and to contact you about your use of our Services.
  • To send you marketing and promotional communications. We may process the personal information you send us for marketing purposes, in accordance with your marketing preferences. You can opt out at any time.
  • To protect our Services. We may process your information to keep our Services safe and secure, including fraud monitoring and prevention.
  • To identify usage trends. We may process information about how you use our Services to better understand and improve them.
  • To contact restaurant business decision-makers. We use publicly available business contact information to reach out to restaurants regarding our AI ordering Service.
  • To operate and maintain the quality of AI-powered order processing. We process conversation content and order data to ensure the AI assistant performs accurately, to diagnose errors, and to improve response quality.
  • To save or protect an individual's vital interest. We may process your information when necessary to save or protect an individual's vital interest.

3. What Legal Bases Do We Rely On To Process Your Information?

In short: We only process your personal information when we believe it is necessary and we have a valid legal reason (i.e., legal basis) to do so under applicable law, like with your consent, to comply with laws, to provide you with services, to fulfill our contractual obligations, to protect your rights, or to fulfill our legitimate business interests.

If You Are Located in the EU or UK

The General Data Protection Regulation (GDPR) and UK GDPR require us to explain the valid legal bases we rely on. We may rely on the following legal bases to process your personal information:

  • Consent. We may process your information if you have given us permission for a specific purpose. You can withdraw your consent at any time.
  • Performance of a Contract. We may process your personal information when necessary to fulfill our contractual obligations to you, including providing our Services or at your request prior to entering into a contract.
  • Legitimate Interests. We may process your information when reasonably necessary to achieve our legitimate business interests and those interests do not outweigh your interests and fundamental rights and freedoms. For example, we may process your information to:
    • Send users information about special offers and discounts on our products and services
    • Analyze how our Services are used so we can improve them
    • Diagnose problems and prevent fraudulent activities
    • Understand how users use our products and services so we can improve user experience
    • Grow our business by informing relevant restaurant businesses about services that may benefit their operations (this includes B2B outreach using publicly available business contact information of restaurants)
    • Provide a reliable and accurate service to restaurant businesses and their customers (this includes processing conversation content to maintain AI quality)
  • Legal Obligations. We may process your information where necessary for compliance with our legal obligations.
  • Vital Interests. We may process your information where necessary to protect your vital interests or those of a third party.

If You Are Located in Canada

We may process your information if you have given us specific permission (express consent), or in situations where your permission can be inferred (implied consent). You can withdraw your consent at any time.

In some exceptional cases, we may be legally permitted under applicable law to process your information without your consent, including for investigation, fraud detection and prevention, business transactions, identifying injured persons, financial abuse cases, and other circumstances permitted by law.


4. When And With Whom Do We Share Your Personal Information?

In short: We may share information in specific situations described in this section and with the following categories of third parties.

  • AI Platforms (e.g., OpenAI) for AI-powered conversation handling
  • Cloud Computing Services (e.g., AWS) for hosting and infrastructure
  • Communication & Collaboration Tools (e.g., Twilio for SMS, Meta/WhatsApp for messaging)
  • Data Analytics Services for understanding usage patterns
  • Data Storage Service Providers for data persistence
  • Order Fulfillment Service Providers (Square POS) for order processing
  • Payment Processors (Square, Stripe) for payment processing
  • User Account Registration & Authentication Services
  • Website Hosting Service Providers (Vercel, Cloudflare)

These service providers process information on our behalf and on behalf of the restaurants using our Service, and are contractually prohibited from using your data for their own purposes.

Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

We do not sell or share your personal information for cross-context behavioral advertising.


5. Do We Offer Artificial Intelligence-Based Products?

In short: Yes. Our Services are fundamentally AI-powered.

As part of our Services, we offer products, features, and tools powered by artificial intelligence, machine learning, and similar technologies (collectively, "AI Products"). These tools are designed to handle complex customer conversations and orders for restaurants.

Use of AI Technologies

We provide AI Products through third-party service providers ("AI Service Providers"), including OpenAI. As outlined in this Privacy Notice, your input, output, and personal information will be shared with and processed by these AI Service Providers to enable your use of our AI Products.

We have agreements with these providers that prohibit them from using your data to train their AI models. You can review their privacy policies at:

You must not use the AI Products in any way that violates the terms or policies of any AI Service Provider.

Voice Message Processing

When users send voice messages through our Service, we transcribe the audio to text using third-party speech-to-text providers. The original audio recording is deleted within 24 hours of transcription. The transcribed text is treated the same as written messages and processed according to this Privacy Notice.

Our AI Products

Our AI Products are designed for the following functions:

  • AI applications
  • AI automation
  • AI bots (conversational agents)
  • Natural language processing
  • Text analysis

AI Decision-Making and Limitations

Our AI assistant makes automated decisions to process orders (such as identifying menu items, applying modifications, and calculating totals). These decisions do not have legal or significantly similar effects on individuals. You may always request human assistance from the restaurant by indicating so during the conversation.

How We Process Your Data Using AI

All personal information processed using our AI Products is handled in line with this Privacy Notice and our agreements with third parties. Conversations are isolated per restaurant and not used for cross-customer model training.

How to Opt Out

Because our Service is fundamentally AI-based, opting out of AI processing means opting out of the Service. However, you can:

  • Request that your conversation history and stored attributes be deleted at any time by contacting privacy@yorcle.com or by contacting the restaurant directly
  • Request human (non-AI) assistance from the restaurant during a conversation

6. Is Your Information Transferred Internationally?

In short: We may transfer, store, and process your information in countries other than your own.

Our servers are located in the United States. We operate from India, and our infrastructure may process data in both locations. Regardless of your location, your information may be transferred to, stored by, and processed by us and our service providers in our facilities and in facilities located in the United States, India, and other countries.

If you are a resident of the European Economic Area (EEA), United Kingdom (UK), Switzerland, or Canada, the countries to which we transfer data may not necessarily have data protection laws as comprehensive as those in your country. However, we take all necessary measures to protect your personal information in accordance with this Privacy Notice and applicable law.

European Commission's Standard Contractual Clauses

We have implemented measures to protect your personal information, including using the European Commission's Standard Contractual Clauses for transfers between us and our third-party providers. These clauses require all recipients to protect personal information originating from the EEA or UK in accordance with European data protection laws.

7. How Long Do We Keep Your Information?

In short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise required by law.

We will only keep your personal information for as long as necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).

No purpose in this notice will require us to keep your personal information for longer than twenty-four (24) months past the termination of the user's account. Tax and billing records may be retained for up to seven (7) years as required by applicable law.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if not possible (for example, because your information has been stored in backup archives), we will securely store your information until deletion is possible.

Specific retention periods:

  • Conversation content and order history: retained while the restaurant's account is active; deleted within 24 months of account termination
  • Audio recordings (voice messages): deleted within 24 hours of transcription
  • Restaurant billing records: retained for up to 7 years as required by law
  • Cold outreach lead data: retained for up to 90 days if no contact is made; deleted thereafter

8. How Do We Keep Your Information Safe?

In short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. These include:

  • HTTPS encryption for all data in transit
  • Encryption at rest for stored data
  • Strong password hashing
  • Restricted access to personal data on a need-to-know basis
  • Logging of access to sensitive data
  • Regular dependency updates and security monitoring

However, despite our safeguards and efforts to secure your information, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure. We cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information.


9. Do We Collect Information From Minors?

In short: We do not knowingly collect data from or market to children under 18 years of age.

Our Service is not directed to individuals under the age of 18 (or the applicable minimum age in your jurisdiction). We do not knowingly collect personal information from children. If we become aware that a child has provided us with personal information, we will take steps to delete such information.

10. What Are Your Privacy Rights?

In short: Depending on your jurisdiction, you may have rights that allow you greater access to and control over your personal information.

In some regions (like the EEA, UK, Switzerland, and Canada), you have certain rights under applicable data protection laws. These may include the right to:

  • Request access and obtain a copy of your personal information
  • Request rectification or erasure
  • Restrict the processing of your personal information
  • Data portability (where applicable)
  • Not be subject to automated decision-making with legal or similarly significant effects

If a decision producing legal or similarly significant effects is made solely by automated means, we will inform you, explain the main factors, and offer a way to request human review. (As described in Section 5, our AI ordering decisions do not produce such effects.)

In certain circumstances, you may also have the right to object to the processing of your personal information.

You can make any such request by contacting us via the details in Section 15 or visiting yorcle.com/contactus. We will consider and act upon any request in accordance with applicable data protection laws.

If you are located in the EEA or UK and you believe we are unlawfully processing your personal information, you have the right to complain to your Member State data protection authority or the UK Information Commissioner's Office (ICO).

If you are located in Switzerland, you may contact the Federal Data Protection and Information Commissioner.

Withdrawing Your Consent

If we are relying on your consent to process your personal information, you have the right to withdraw it at any time by contacting us using the details in Section 15. However, this will not affect the lawfulness of processing before your withdrawal, nor will it affect processing conducted in reliance on lawful processing grounds other than consent.

Account Information

If you would at any time like to review or change the information in your account or terminate your account, you can contact us at privacy@yorcle.com.

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. We may retain some information in our files to prevent fraud, troubleshoot problems, assist with investigations, enforce our legal terms, and/or comply with applicable legal requirements.


11. Controls For Do-Not-Track Features

Most web browsers and some mobile operating systems include a Do-Not-Track ("DNT") feature you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.

If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.

California law requires us to let you know how we respond to web browser DNT signals. Because there is no industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.


12. Do United States Residents Have Specific Privacy Rights?

In short: If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia, you may have the right to request access to and receive details about the personal information we maintain about you and how we have processed it, correct inaccuracies, get a copy of, or delete your personal information. You may also have the right to withdraw your consent to our processing of your personal information.

How We Use and Share Personal Information

We use and share personal information as described in Sections 2 and 4 of this Notice.

We have not sold or shared (as defined under applicable state law) personal information in the preceding twelve (12) months. We do not engage in targeted advertising. We will not sell or share personal information in the future without providing notice and an opportunity to opt out.

We have disclosed the following categories of personal information to third parties for business purposes in the preceding twelve (12) months:

  • Identifiers
  • Personal information as defined in the California Customer Records law
  • Commercial information
  • Internet or other similar network activity
  • Geolocation data
  • Audio/sensory information

Your Rights

We will verify your request using reasonable means in accordance with applicable law. If we cannot verify your identity, we may request additional information.

You may also designate an authorized agent to make a request on your behalf. We will deny such request if the agent does not submit proof of authorization.

We will respond to your request within the timeframe required by applicable law (typically 45 days, with possible extensions).

Right to Appeal

If we decline to take action regarding your request, you may appeal our decision by contacting us at privacy@yorcle.com.

California Specific Rights

California residents have specific rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA). The rights described above apply, plus:

  • Shine the Light Law (CA Civil Code Section 1798.83): California residents may request information about disclosures of personal information for direct marketing purposes once a year. We do not disclose personal information for direct marketing purposes.

Metrics

We do not currently meet the threshold (10 million California residents annually) requiring publication of data subject access request metrics.


13. Do Other Regions Have Specific Privacy Rights?

Australia and New Zealand

In short: You have rights under Australian and New Zealand privacy laws, including access to and correction of your personal information.

We collect and process your personal information under the obligations and conditions set by Australia's Privacy Act 1988 and New Zealand's Privacy Act 2020.

This Privacy Notice satisfies the notice requirements defined in both Privacy Acts, in particular: what personal information we collect from you, from which sources, for which purposes, and other recipients of your personal information.

If you do not wish to provide the personal information necessary to fulfill their applicable purpose, it may affect our ability to provide our services, in particular:

  • Offer you the products or services you want
  • Respond to or help with your requests
  • Manage your account with us
  • Confirm your identity and protect your account

At any time, you have the right to request access to or correction of your personal information. You can make such a request by contacting us using the contact details provided in Section 15.

If you believe we are unlawfully processing your personal information, you have the right to submit a complaint about a breach of the Australian Privacy Principles to the Office of the Australian Information Commissioner and a breach of New Zealand's Privacy Principles to the Office of New Zealand Privacy Commissioner.

South Africa

We do not currently target South African users. If you become aware that your personal information has been collected, please contact us using the details in Section 15.

Switzerland

If you are a resident of Switzerland, you may contact the Federal Data Protection and Information Commissioner regarding any concerns about our processing of your personal information.
